You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at https://webhosting.1.wien/en/withdraw-contract (button “Withdraw from contract here” in the footer of every page of our Shop and for each contract in your customer area). If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Additional information on withdrawal

This information is not part of the statutory model withdrawal policy. It explains how withdrawal works at 1.wien Webhosting.

When is the contract concluded? With our order confirmation by e-mail, which we send after receiving your payment (clause 2.5 of the Terms). The withdrawal period starts on that day; the date is stated in the order confirmation.

When do we start performing? If you did not expressly request an earlier start when ordering, we only start on the day after the withdrawal period ends. A withdrawal within the period then costs you nothing; you receive the full amount paid back. If you requested an early start, we start on the day the contract is concluded.

How do we calculate the proportionate amount? The basis is the total price for the minimum term of twelve months, spread evenly over its days (365 or 366 days). We count the days from the service start to the day on which you inform us of the withdrawal, both inclusive, and round commercially to whole cents. Example: “Start” plan, paid monthly at €4.90 (consumer in Austria); total price for twelve months €58.80; withdrawal on the 7th day. Proportionate amount: €58.80 × 7 / 365 = €1.13. We refund €4.90 − €1.13 = €3.77. If we had not properly informed you of the right of withdrawal or of the payment obligation, you owe no proportionate amount (§ 16(2) FAGG).

Refund. We issue a credit note and refund the amount within 14 days of receiving your withdrawal to the payment method you used. You incur no other costs as a result of the withdrawal.

Your data. After the withdrawal we suspend your hosting. We keep your content available for retrieval for 30 days and, on request, hand it over to you free of charge in a commonly used, machine-readable format (§ 14(7) FAGG); then we erase it (§ 12 of the Terms).

Withdrawal or termination? Withdrawal ends the contract within the 14-day period. After that you can terminate the contract under § 7 of the Terms, through “Cancel contracts here” in the footer.
